This agreement governs your use of the HumbleWorth website and services. Please read it before relying on anything the site produces.

1. Introduction

Welcome to HumbleWorth. This Terms of Service agreement ("Agreement") is between you and HumbleWorth and governs your use of our website and services. Please read it carefully.

2. Acceptance of terms

This Agreement is effective as of the date you first use our website or services and continues until terminated by either party. By using our website or services, you agree to be bound by this Agreement. If you do not agree to this Agreement, do not use our website or services.

You must be at least 16 years old (or 13 with parental consent) to use the Service.

3. Changes to terms

We may modify this Agreement from time to time. If we make material changes to this Agreement, we will notify you by posting the revised Agreement on our website or through our services. By continuing to use our website or services after the revised Agreement has been posted, you agree to be bound by the revised Agreement.

4. Use of website and services

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to use our website and services.

Some links on the Service are affiliate or sponsored links; we may earn a commission or fee if you click or purchase through them. Each is labelled where it appears, and our Affiliate Disclosure explains the arrangement in full.

4a. Third-party providers

HumbleWorth links to independent third parties: registrars, backorder and drop-catch services, domain marketplaces, brokers, hosting providers, transfer services, and escrow providers. We are not the seller, registrar, marketplace, broker, host, or escrow agent in any of those transactions, and we are not a party to them.

Anything you buy from or agree with a provider is governed entirely by that provider's own terms and privacy policy. Their prices, fees, availability, eligibility rules, and service levels are set by them and can change at any time without notice to us. We make no warranty about any provider and accept no liability for their acts or omissions.

Listing a provider on HumbleWorth is not an endorsement of its suitability for your situation, and is not professional, legal, tax, or financial advice.

4b. Domain availability

Where we show whether a domain appears registered or available, that reflects a registry lookup at a point in time. Domain registration status changes continuously and can change between our check and your attempt to register. We do not guarantee that any domain shown as available can still be registered, nor that any domain shown as registered is genuinely for sale.

Where we cannot obtain a definitive answer (including for top-level domains we do not support), we say the status is unknown rather than guessing. Always confirm availability and price at the registrar before relying on it.

5. No automated access

You agree that you will not use any automated program, robot, spider, crawler, scraper, or other automated means to access our domain price estimations. All requests to these endpoints must be made by a human through a standard web browser, unless via our public API under a separate agreement.

6. Newsletter

You can subscribe to our newsletter through the forms on this website. We use your address to send one email a week covering good domains that have recently dropped, what names are selling for, and other domain market information. Some issues include a sponsor. Sponsored content is always labelled as such, and sponsors never receive your address or influence our estimates or which domains appear in Daily Gems.

We will not share your address with third parties without your consent. You may unsubscribe at any time using the link in the footer of every newsletter we send. Nothing in the newsletter is investment advice, and any domain we mention or value remains an estimate and an opinion.

7. Dropped domain names

HumbleWorth displays dropped domain names. We do not own these domain names, and we are not affiliated with the domain name registrar. We do not guarantee that these domain names are available for registration. We also have no control over the content of these domain names. We refresh our dropped domain listings regularly and do not claim ownership of any displayed domains. All dropped domains are displayed for a maximum of 24 hours to ensure the freshness of the content on our website.

8. Prohibited uses

You may not use our website or services for any illegal or unauthorized purpose. You agree to comply with all applicable laws in your use of our website or services.

9. Termination

We may terminate your account or your use of our website or services at any time, for any reason, and without notice.

10. Disclaimer of warranties

Our website and services are provided "as is" and "as available." We make no warranties, express or implied, including without limitation, warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our website or services will be available at all times, will be secure or error-free, or that the results of using our website or services will meet your expectations. We provide domain name estimates and recommendations on a "best effort" basis and make no guarantees regarding their accuracy or completeness. We do not provide financial or investment advice.

11. Limitation of liability

In no event shall we be liable for any direct, indirect, incidental, special, punitive, or consequential damages, or any other damages of any kind, arising out of or in connection with this agreement or your use of our website or services, whether in contract, tort, or otherwise, including without limitation, damages for loss of use, data, or profits, or for the cost of procuring substitute goods or services.

To the maximum extent permitted by law, our total liability shall not exceed the greater of (a) US $100 or (b) the amount you paid us (if any) in the 12 months before the event giving rise to liability.

12. Automated estimates and limitations

Our estimation numbers are computer-generated estimates only, based on historical data and statistical models. They:

Are not guaranteed to reflect actual market values or sale prices
Do not constitute professional appraisals
Should not be relied upon as the sole basis for investment decisions
May vary significantly from what a domain actually sells for
Are provided for informational purposes only
Do not guarantee that a domain can be resold at, near, or above the estimate

By using our service, you acknowledge that all estimations are automated estimates and agree not to rely on them as definitive values. Always consult with domain professionals or conduct your own research before making investment decisions.

13. Estimation accuracy

We provide domain name value estimates as a way of guiding you with your domain investments. Our estimation process is based on statistical models and domain name auction history. However, we do not know all the factors involved in the auction values that domains have received in the past, and our estimates are not guaranteed. These estimates should only be used as a guide. We also recommend domain names in our newsletter. These domain names are merely recommendations, and you should use your best judgment to ensure you're buying domains that would be a good investment.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable attorney's fees and costs, arising out of or in connection with your use of our website or services or your violation of this Agreement.

15. Miscellaneous

This Agreement constitutes the entire agreement between you and us regarding your use of our website and services. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Our failure to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.

We shall not be liable for any failure or delay in performance under this Agreement due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor or materials.

17. Governing law; dispute resolution

This Agreement is governed by the laws of the State of Delaware, USA, excluding its conflict-of-law rules.

Binding arbitration

Any dispute arising out of or relating to this Agreement or the Service shall be finally resolved by confidential, binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted by one arbitrator, in English, by video conference unless the arbitrator requires otherwise.

Class-action waiver

You and HumbleWorth agree that any claims will be brought solely in your or HumbleWorth's individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

Limitation period

Any claim must be filed within one (1) year after the cause of action arose.
